Mumbai: The family of a 26-year-old man who died in an accident while chasing a rickshaw for holiday money will get Rs 43 lakh. In 2016, a young man living in Vikhroli was chased by a rickshaw puller after he refused to pay the remaining 28 rupees. However, he lost his life in the accident. Chetan Archinekar was a young man working in a software company. While returning home from the rickshaw, his rickshaw fare was Rs 172. Then he gave 200 rupees to the rickshaw driver. However, the driver refused to pay the remaining Rs. 28 to Chetan. At that time, after Chetan had an argument with the rickshaw driver, the driver tried to run away by speeding the rickshaw. However, he came to Chetan at the same time but the rickshaw driver hit him. Chetan died a tragic death. The tremor occurred in the eyes of Chetan’s father.

The claim made by Future General India Insurance has been dismissed by the Motor Accident Claims Tribunal (MACT). Future General India had claimed that this was a guilty murder case and we were not responsible. However, the tribunal refuted this claim, citing the death certificate and post-mortem report, pointing out that Chetan’s death was due to serious injuries sustained in a motor vehicle accident. “The manner in which the accident took place clearly shows that the driver of the autorickshaw had a chance to avoid an accident. However, the driver was negligent and responsible for the accident, “said a tribunal headed by AM Chandekar.

Chetan Archinekar was working in a software company at the time of the accident. At that time his monthly salary was Rs. 15,000. Considering Chetan’s monthly salary at that time, his parents should get compensation from Ganapan, Sneha and younger brother Omkar Archinekar, the tribunal said. The tribunal also ruled that the insurance company and the owner of the autorickshaw, Kamlesh Mishra, would have to pay Rs 43 lakh (including interest) jointly. Chetan’s family had filed their suit before the tribunal in December 2016. He said that on July 23, 2016, around 1.30 am, an autorickshaw was returning from Chetan Airport to his home in Vikhroli East. He paid Rs 200 to the driver when he approached the house. However, the driver refused to pay the rest. He also started a rickshaw, claiming that he had no money.

When Chetan told him to stop, he tried to speed up. As a result, the vehicle overturned and crashed on Chetan’s body. Chetan was seriously injured in the accident. The case was registered at Vikhroli police station. The family members said that Chetan’s death had affected his parents both emotionally and financially. Meanwhile, the autorickshaw driver did not appear before the tribunal and an earlier order was issued against him. At the time of Chetan’s family’s argument for denying the amount of the claim, the insurance company had stated that the rickshaw driver did not have a valid driving license. However, the insurance company did not attach any oral or documentary evidence, the tribunal said in a statement.
