…then Shinde government will be dismissed: Legal expert Ulhas Bapat

Pune: A very important hearing was held today in the Supreme Court regarding the political tussle between Shiv Sena led by Uddhav Thackeray and the group led by Eknath Shinde. The Supreme Court has postponed the hearing and the next hearing will be held on August 1. However. Before that, legal expert Ulhas Bapat has made an indicative statement.

The Shiv Sena has demanded disqualification of the MLAs from the Shinde group, on the other hand, the Shinde group has demanded action against the Shiv Sena MLAs who defied the ‘whip’ issued by the Shinde group during the election of the Assembly Speaker and the vote of confidence on the government. A hearing on these demands was held in the Supreme Court today and strong arguments were made by the lawyers of the leaders of both the parties. After the arguments of the lawyers, Chief Justice N. V. The bench headed by Ramana adjourned the hearing till August 1.

Shiv Sena party leader Sunil Prabhu had disqualified 16 rebel MLAs of Shiv Sena when Narahari Jhirwal was sitting as deputy chairman. Chief Minister Eknath Shinde is also included in this. The Shinde group had filed a petition in the Supreme Court against this action. However, constitutional expert Ulhas Bapat expressed the opinion that if 16 MLAs are disqualified, then the government in the state may be dissolved.

Chief Minister Eknath Shinde’s name is also among the 16 MLAs for whom emergency action has been taken. A minister can remain a minister even if he is not a member. But if action has been taken under Antidefection law, that MLA cannot remain a minister. Therefore, Ulhas Bapat has observed that if 16 MLAs fail, the government can be dissolved.
