Former Home Minister Anil Deshmukh’s chances of getting a chance to vote are slim; Reason

Mumbai: The chances of NCP leader and former home minister Anil Deshmukh getting a chance to vote in the Rajya Sabha elections are slim. This is because the petition of Cabinet Minister Nawab Malik has been heard and no positive order has been issued yet. The subjects of hearing in each High Court are assigned by the Chief Justice. Accordingly, the matter may go to Justice Prakash Naik or Justice Bharti Dangre for hearing. However, Justice Prakash Naik and Justice Bharti Dangre had earlier refused to hear cases related to Deshmukh on personal grounds.

Against this backdrop, Anil Deshmukh’s lawyers will have to go to the Chief Justice and request for a special single bench to hear the petition. The process of appointing such a special bench is time consuming. Moreover, as no positive order has been issued in the case of Nawab Malik and the time for voting in the Vidhan Bhavan is only till 4 pm, Deshmukh’s counsel does not seem to be keen to make a request to the Chief Justice to appoint a special bench. As a result, Deshmukh’s chances of getting a vote are slim.

    Justice Prakash Naik has not given any immediate relief to Minister Nawab Malik regarding voting in Rajya Sabha elections. However, the petition has been amended and permission has been granted to go to the appropriate court. Malik’s plea is likely to be heard in another court at 1.30 pm after an urgent amendment.
