12 new faces soon for ‘Governor Appointee’; The Shinde government will give a new list to the governor

Mumbai: The list of 12 members for the Legislative Council sent by the Mahavikas Aghadi government to Governor Bhagat Singh Koshyari two years ago was not approved by the Governor until the Aghadi government came down from power. Now the Shinde-Fadnavis government that has come to the state has decided to recall this list and instead a new list will be sent to the Governor. BJP leader and newly appointed minister Chandrakant Patil has confirmed this news. It is being said that all this has been played to increase the number of members of the new government in the legislative council and on this occasion the decisions of the government should not come in the way.

After the Mahavikas Aghadi government came to power in the state, the list of 12 members appointed by the Governor was sent to the Governor. However, the Governor neither gave the green light to this list nor commented that the list was not approved. Even after the state government filed a petition in the court in this matter, the governor did not take any decision. Many ministers of the Thackeray government including the Chief Minister and Deputy Chief Minister met the Governor several times for this purpose. But still the file of membership list did not move forward. Even after resigning as Chief Minister, Uddhav Thackeray had challenged the Governor over the issue of these 12 MLAs. But now, the new government in the state has decided to speed up the file of this list. However, this motion will be given in the opposite direction and it has been decided to recall this list. Canceling the recalled list, the Shinde-Fadnavis government will send a new list to the Governor.

State minister and BJP leader Chandrakant Patil has confirmed the news that the old list will be recalled and a new list will be sent. A proposal has to be made to recall the old list. As it has been done in the Cabinet meeting, it is a part of the process. Chandrakant Patil also said that we do not know exactly when the governor will return the list and when a new list will be given to the governor. According to the information given by Patil, now it is clear that the list of the previous Thackeray government will be dropped, and the dream of the members of this list to become MLAs will vanish. On the other hand, aspirants will start running to get their names included in this list.

Names in the leading list

The Maha Vikas Aghadi named among the Governor-appointed MLAs included four members from three parties namely Shiv Sena, Congress and Nationalist Congress Party. From Shiv Sena, the names of Urmila Matondkar, Nitin Bangude Patil, Vijay Karanjkar and Chandrakant Raghuvanshi were included. Names of Eknath Khadse, Raju Shetty, Yashpal Bhinge and Anand Shinde from NCP; While from Congress, Rajni Patil, Sachin Sawant, Muzaffar Hussain and Anirudh Vankar were included. Among them, only Eknath Khadse has been mentioned on the Legislative Council

How are Governor appointed MLAs selected?

The Constitution has given the Governor the power to make appointments to the vacancies in the Legislative Council. However, they have to consult the Chief Minister to make this appointment. Under Article 163(1) the Governor can make appointments to the seats of the Legislative Council. According to Article 171(5), the Governor can appoint persons in five fields namely literature, art, science, social, cooperation. MLAs are appointed by the Governor on the advice of the Chief Minister and the Cabinet. However, there is no clear mention in the law as to how many days this appointment should be made after the list is given by the government.
