The Supreme Court is likely to hear the petitions filed on the power struggle tomorrow. Also, the newly elected Chief Justice of the Supreme Court Uday Lalit indicated that a constitution bench of three judges may be formed during this hearing. The petition was filed by the Shinde group in the Supreme Court seeking removal of restrictions on the Election Commission’s hearing. He also demanded an immediate hearing on this petition. Taking cognizance of this petition, Uday Lalit has given these indications. The Supreme Court had ordered the Election Commission not to announce any result or hold a hearing until the Supreme Court’s decision is forthcoming. Hence, the dispute regarding the party and symbol is pending with the Election Commission. The Shinde group has filed a new petition in the Supreme Court to resolve this dispute. A petition has been made by the Shinde group in the Supreme Court that the hearing of the Election Commission should not be adjourned. Also, a request has been made to hear the petition expeditiously.

In a hearing held on August 24, the matter was referred to a three-judge constitution bench. In this matter, the constitution bench was supposed to be established on August 25, but it has not been established yet. Meanwhile, assembly by-elections have started in some parts of the state. Also, there will be municipal elections. Therefore, through a petition, the Shinde group has demanded that the Election Commission should be ordered to continue the process of hearing.

40 Shiv Sena MLAs revolted under the leadership of incumbent Chief Minister Eknath Shinde, pulling down the Thackeray government. After that, Eknath Shinde formed the government with the help of BJP along with these 40 Shiv Sena MLAs along with 10 other MLAs. Due to this, two groups have formed in Shiv Sena itself. The dispute between the two factions in the Shiv Sena has reached its peak. On the one hand, the Supreme Court is hearing the disqualification of MLAs. On the other hand, the dispute over who is the real Shiv Sena has reached the threshold of the Central Election Commission. But at the same time, the Thackeray group has also knocked the doors of the Supreme Court for this.

As the Shinde group claimed the party and symbol, the Election Commission had ordered both the groups to submit documents regarding the party and symbol. Accordingly, Shiv Sena has been given a deadline till September 23. Shiv Sena had asked for an extension of four weeks. Accordingly, they have been extended. If the party and symbol dispute is resolved, it will be easier for both groups to prepare for the elections, hence this petition has been filed.

Meanwhile, the Supreme Court has ordered that the Election Commission should not hold any hearing unless there is an order from the Supreme Court. Hence the controversy over party and symbol is pending. As the dispute over the power struggle in the state is pending in the Supreme Court, it is still unclear when the verdict will be delivered. Also, as the case has now gone to the Constitution Bench, the hearing is likely to be delayed further. There is a possibility that the case in the Election Commission will also remain pending. Therefore, the Shinde group has petitioned the Supreme Court to remove the restriction on the Election Commission’s hearing. It has also been demanded that the petition filed by the Shinde group should be heard quickly. Therefore, there is a possibility that the power struggle in the state will end in the near future.

“Many people had drowned God. There will be a hearing in the Supreme Court, Shinde group MLAs will be disqualified. After that, many people are hoping that our government will collapse. But I tell you that our complaint has gone to the Constitution Bench. This is going to last for almost four to five years now. By winning the second election, we will come back to power”, Shinde MLA Bharat Gogawle had said. It is said by political experts that the Shinde group may have made a new move and filed a petition in the Supreme Court in connection with the hearing of the Election Commission, as there is a possibility that this case will be pending for four to five years after it goes to the Constitutional Court.
