Illegal decision to increase the number of councillors; Illegal administration by State Election Commission

Due to the corona epidemic, the census of the year 2021 could not be conducted till date. Therefore, the government has increased the number of Nagsevaks as per the population. It is wrong and illegal. Also, due to the existence of a law in March 2022, the government canceled the ward formation, so the ward formation through the State Election Commission cannot be implemented. Therefore, the election process being carried out by misinterpreting the order of the Supreme Court is illegal and the reservation lottery program is illegal. Former BJP Standing Committee President Vilas Madigeri has demanded the state government to cancel this entire process immediately.
In this regard, Vilas Madigeri said that for 13 municipal corporations in Maharashtra, the 3-member ward structure has been finalized on 13/05/2022 as per the amendment made by the Maha Vikas Aghadi government on 30-9-2021 by the State Election Commission. But as per Supreme Court’s order dated 04/05/2022 and again dated: 20/07/2022 Supreme Court has ordered to conduct the election process in 2 weeks as per ward structure available on 10/03/2022. That means the 2017 ward formation was final on 10/03/2022. Also, the census was conducted in the year 2011. Due to the corona epidemic, the census of the year 2021 could not be conducted till date. Therefore, the government increased the number of Nagsevaks from 128 to 139 for the Pimpri Chinchwad Municipal Corporation General Election-2022 keeping in mind this population. That is also wrong and illegal. Because, if the census is not done, the number of members of the people’s representatives cannot be increased.
Ward formation through the State Election Commission cannot be implemented as there is an existing law which abolished the ward formation by the government in March 2022. Therefore, the election process followed by misinterpreting the order of the Supreme Court, declaring the final ward composition, announcing the election programs like reservation, voter list are illegal. Therefore, it should be noted that a written objection and suggestion is registered on such illegal draw. The said ward structure is flawed. However, it is wrong that the said action is being taken in haste on the pretext that it is as per the order of the Supreme Court. The state government should also consider the said order given by the Supreme Court.
A total of 5644 objections were filed by citizens from Pimpri Chinchwad Municipal Corporation. The municipal administration and the state election commission have ignored it and have also disrespected the public opinion. While announcing the program of General Election-2022, at every stage (at the hearing of ward formation objection, reservation objection, voter list objection), all the objections have been rejected under political pressure and the rules have been wrongly violated. In fact, when the Election Commission announced a new OBC reservation program, it was also necessary to announce a new ward structure.
I have been wronged by the citizens of my ward. Therefore, I hon. A petition has already been filed in the Bombay High Court vide Petition No. WP/6250 of 2022, and this intervention has been filed in the Supreme Court vide IA NO: 92911/2022 (with wp no: 238/2022). My hearing is pending on it. Vilas Madigeri has mentioned in the manifesto that after considering all this, the state government should immediately take a proper decision in this regard and stop the process going on through the State Election Commission and the system.
